Terms and Conditions of Byzzard Service

1. WHO IS THIS FOR (B2B ONLY)

1.1 Business Use Only. Our Services are designed exclusively for companies and business professionals. By signing up, You confirm You are not a consumer and have the authority to represent Your company.

1.2 Trade Sanctions. You represent that You are not located in or sanctioned by countries subject to EU/US embargoes (e.g., Russia, Iran, North Korea).

2. HOW THE SERVICE WORKS

2.1 Scope. Byzzard provides access to curated innovations, product patterns, UX flows, and analytics for internal research, inspiration, and benchmarking.

2.2 Service Tiers.

• Public: Free teaser content (no login required).
• Trial: Limited free access for evaluation. We provide this "AS-IS" and may end it anytime.
• Paid: Full access subject to subscription fees.

2.3 No Guarantees (SLA). Unless You buy a specific Enterprise SLA, We provide the Service on a "reasonable efforts" basis. We do not guarantee 100% uptime. We rely on third-party providers (like OpenAI or AWS) and are not liable if they go down.

3. PAYMENTS & SUBSCRIPTIONS

3.1 Fees. Paid access is billed in advance. No Pay = No Service. If payment fails, We may suspend access immediately.

3.2 Refunds. All fees are non-refundable, even if You cancel mid-month.

3.3 Seats. Access is per-seat. You may not share one login credential among multiple employees.

4. AI & "NO ADVICE" DISCLAIMER

4.1 AI Hallucinations. Our chat features use AI (LLMs). You acknowledge that AI can make mistakes, hallucinate, or provide inaccurate info.

4.2 Not Professional Advice. While We may offer consultancy services separately, the Byzzard Platform itself is an automated tech tool, not a consultant. Our AI outputs are not legal, tax, or financial advice.

4.3 Your Responsibility. You are solely responsible for validating any AI output before making business decisions (e.g., changing pricing).

5. YOUR DATA & OUR RIGHTS

5.1 Your Content. You own the data and prompts You upload ("User Content").

5.2 License to Improve. By using Byzzard, You grant Us a license to use Your User Content to provide and improve the Service (including training our AI models), unless Your Enterprise agreement says otherwise.

5.3 Privacy Shield. You promise not to upload personal data of third parties (GDPR data like customer emails). If You do, You are solely responsible.

5.4 Feedback. If You give Us ideas or feedback, We can use them freely to improve Byzzard without owing You money or credit.

6. WHAT YOU CANNOT DO

6.1 Acceptable Use. You agree not to:

• Scrape or copy our data using bots/scripts.
• Reverse engineer our algorithms.
• Build a competing product using our content.
• Share Your account with people outside Your organization.

7. LIABILITY & DAMAGES (READ CAREFULLY)

7.1 Financial Cap.

• Free/Trial: Our liability is limited to 0 CZK.
• Paid: Our liability is limited to the fees You paid in the last 1 month.

7.2 Exclusions. We are not liable for lost profits, data loss, or indirect damages.

7.3 Legal Minimum. These limitations apply to the maximum extent permitted by law but do not exclude liability for damages caused by our willful misconduct or gross negligence.

8. TERMINATION & EXIT

8.1 Cancellation. You can stop using Byzzard at any time. We may suspend You immediately if You break these rules (especially scraping or non-payment).

8.2 Data Wipe. Upon termination, We have no obligation to keep Your data. We may delete User Content immediately.

9. LEGAL JURISDICTION

9.1 Governing Law. These Terms are governed by Czech Law.

9.2 Disputes. Any lawsuits must be filed exclusively in the courts of Prague, Czech Republic.

9.3 Class Action Waiver. You agree to resolve disputes individually, not as part of a class action.

10. FINAL STUFF

10.1 Updates. We may update these Terms. If You continue using the Service, You agree to the new version. If You disagree with a material change, You must stop using the Service.

10.2 Marketing. We can use Your logo to say You use Byzzard (e.g., "Trusted by..."). You can opt-out via email.

10.3 Survival. Protections regarding AI, Data Rights, IP, Liability, and Jurisdiction survive the end of this agreement.
